Membership Terms and Conditions

These Membership Terms and Conditions (“Terms”) govern the purchase and use of monthly memberships at Drift Away Wellness Spa, located at 324 58 Ave SE, Calgary, AB T2H 0P1 (referred to in this document as “Drift Away,” “we,” “us,” or “our”). By enrolling in a Drift Away membership, you (“Member,” “you,” or “your”) agree to be bound by these Terms in full.
Please read these Terms carefully before enrolling. If you do not agree to any part of these Terms, do not enrol in a membership. Membership enrolment confirms that you have read, understood, and accepted these Terms.
These Terms operate alongside our Privacy Policy, our Liability Waiver (which Members must sign before their first visit), and our general spa policies, all of which form part of the agreement between you and Drift Away.

1.  DEFINITIONS
In these Terms, the following terms have the meanings set out below:
“Billing Date” means the date each month on which your membership fee is automatically charged, beginning on the date of your initial enrolment and recurring on the same day of each subsequent month.
“Billing Cycle” means the period of approximately 30 days between consecutive Billing Dates.
“Credit or Session Credit” means an entitlement to one (1) included session or service as defined in your chosen Membership Tier.
“Member” means an individual aged 18 years or older who has enrolled in a Drift Away membership and whose membership remains active.
“Membership” means the monthly subscription service provided by Drift Away under one of the Membership Tiers defined in Section 3.
“Membership Tier” means one of the three membership levels offered by Drift Away: Drift Essential, Drift Immerse, or Drift Sanctuary.
“Session” means a single scheduled appointment for a service included in or available through your Membership Tier.
“Services” means the wellness treatments, therapies, and experiences offered by Drift Away, comprising three base services: Contrast & Halo Therapy, Wellness Bath Therapy, and Personalized Massage. Drift Away may offer specific named experiences that combine or extend these base Services (for example, packaged combinations of Contrast & Halo Therapy with Wellness Bath Therapy), which remain Services for the purposes of these Terms.

2.  ELIGIBILITY AND ENROLMENT
2.1  Age Requirement
Membership is available only to individuals who are eighteen (18) years of age or older at the time of enrolment. Drift Away reserves the right to request government-issued identification to verify age. Memberships purchased by, or on behalf of, individuals under 18 will be cancelled and refunded in full.
2.2  Single-Member Accounts
Each Membership is issued to one (1) named individual and is strictly non-transferable. Membership Credits, benefits, and discounts may be used only by the named Member and may not be shared with, gifted to, or used on behalf of any other person, including spouses, family members, or friends. Guest benefits, where included in a Membership Tier, are clearly identified and subject to the conditions in Section 3.
2.3  Enrolment Channels
Members may enrol in a Drift Away Membership through any of the following channels:
Online, via our website at driftawaywellness.ca
By telephone, at 587-333-8957
In person, at the front desk during operating hours
Regardless of enrolment channel, the Member must provide a valid credit card for recurring monthly billing and must complete and sign the Drift Away Liability Waiver before their first Session.

3.  MEMBERSHIP TIERS AND INCLUSIONS
Drift Away offers three Membership Tiers. Each Tier provides a defined set of monthly Credits and benefits. Current Tier inclusions and pricing are published on driftawaywellness.ca/membership and may be updated from time to time in accordance with Section 14.
3.1  Weekday Membership
All Drift Away Memberships are weekday memberships. Included Session Credits in every Tier may be redeemed Monday through Thursday only. Where a Tier provides specific weekend benefits — such as guest passes or weekend discounts — those benefits are clearly identified in the Tier inclusions below and are subject to the conditions stated in this Section.
3.2  Drift Essential
One (1) Contrast & Halo Therapy session (2 hours)
One (1) Loonie Tune Up — a combined session of 1-hour Wellness Bath Therapy plus 1-hour Contrast & Halo Therapy (Salt Room not included)
Ten percent (10%) discount on additional weekday sessions, excluding massage
3.3  Drift Immerse
Two (2) Contrast & Halo Therapy sessions (2 hours each)
Two (2) Loonie Tune Up sessions
Ten percent (10%) discount on weekend Contrast & Halo Therapy and Wellness Bath Therapy sessions, excluding massage
Fifteen percent (15%) discount on additional weekday sessions, excluding massage
3.4  Drift Sanctuary
Three (3) Contrast & Halo Therapy sessions (2 hours each)
Three (3) Loonie Tune Up sessions
One (1) Wellness Bath Therapy guest pass (specifically, one Seaweed Bath and one Beer Bath experience), redeemable on weekends
Fifteen percent (15%) discount on weekend Contrast & Halo Therapy and Wellness Bath Therapy sessions, excluding massage
Twenty percent (20%) discount on additional weekday sessions, excluding massage
3.5  Exclusion of Massage Services
Massage services, including but not limited to Personalized Massage, are not included in any Membership Tier and are excluded from all Member discounts. Massage services may be purchased separately at standard rates.
3.6  Credit Flexibility and Substitution
Drift Away offers flexible credit substitution across two of the three base Services. Any monthly Session Credit included in a Member’s Tier may be exchanged, at the Member’s request and at the time of booking, for any other Service of equal value drawn from Contrast & Halo Therapy or Wellness Bath Therapy, including specific branded experiences such as Beer Bath, Seaweed Bath, or Nordic Ritual.
The following conditions apply to all Credit substitutions:
Substitutions must be requested at the time of booking. Once a Service has been redeemed, it cannot be retroactively substituted.
“Equal value” is determined by the standard, non-Member retail price of each Service. Drift Away will inform the Member of any value difference at the time of booking.
Substitutions must comply with the weekday-only redemption rule in Section 3.1, except where the original Credit is itself a weekend benefit (such as the Drift Sanctuary guest pass).
Personalized Massage is fully excluded from all Member benefits, including substitution. A Credit cannot be exchanged for a Massage session under any circumstances. Massage services remain available for purchase at standard, non-Member rates.
Drift Away reserves the right to limit or decline substitutions where availability or operational constraints require. Where a substitution is declined, the original Credit remains valid and available for its original Service.

4.  BILLING AND PAYMENT
4.1  Recurring Charges
By enrolling, you authorize Drift Away to charge the credit card on file for your monthly Membership fee on each Billing Date until your Membership is cancelled in accordance with Section 7. Monthly fees are charged in advance for the upcoming Billing Cycle.
4.2  Accepted Payment Methods
Memberships are payable by pre-authorized credit card only. Cash, debit, e-transfer, gift cards, and other payment methods are not accepted for recurring membership billing. Members are responsible for keeping their credit card information current and must promptly update Drift Away in the event of a card change, expiry, or replacement.
4.3  Failed Payments
If a scheduled payment fails for any reason (including but not limited to insufficient funds, expired card, declined transaction, or chargeback), Drift Away will attempt to reach the Member at the contact information on file. The Member will have seven (7) calendar days from the date of the failed charge to provide an updated payment method or resolve the payment issue. If payment is not resolved within seven (7) days, Drift Away reserves the right to suspend or terminate the Membership without further notice. Any Credits issued for a Billing Cycle in which payment has not been completed may be forfeited.
4.4  Taxes
All Membership fees are subject to applicable Goods and Services Tax (GST) and any other taxes required by law. Tax is calculated on the displayed fee and charged at the time of each recurring payment.
4.5  Pricing Changes
Drift Away reserves the right to modify Membership pricing. Existing Members will receive at least thirty (30) days’ written notice of any price change before it takes effect. If a Member does not wish to continue at the new price, they may cancel their Membership under Section 7 with no penalty.

5.  CREDIT POLICY
5.1  Credit Issuance
Session Credits for each Billing Cycle are issued to the Member’s account on the Billing Date and become available for booking immediately.
5.2  Credit Expiry
ALL SESSION CREDITS EXPIRE AUTOMATICALLY ON THE NEXT BILLING DATE. UNUSED CREDITS DO NOT ROLL OVER, ARE NOT REFUNDABLE, AND HAVE NO CASH VALUE. THIS POLICY APPLIES STRICTLY AND WITHOUT EXCEPTION.
Members are encouraged to book their Sessions early in each Billing Cycle to ensure full use of Credits before expiry. Drift Away makes no representation or guarantee that appointments will be available on any specific date, and the unavailability of a preferred time slot does not extend Credit validity.
5.3  No Cash Value
Session Credits have no cash value and cannot be exchanged for cash, gift cards, or credit toward retail purchases. Credits cannot be transferred between Members or to non-members.
5.4  No Retroactive Credits
Members who join mid-month receive a full Cycle of Credits beginning on their initial Billing Date. Credits will not be prorated or backdated.

6.  SESSION BOOKING, LATE CANCELLATION, AND NO-SHOW POLICY
6.1  How to Book
Members may book Sessions online through the Drift Away booking system, by telephone, or in person at the front desk. All bookings are subject to availability. Member bookings count against the Member’s Credit balance for the current Billing Cycle at the time of booking confirmation.
6.2  Weekday Availability
As stated in Section 3.1, all included Sessions are available Monday through Thursday only. Members may book additional Sessions on weekends at applicable Member discounts where their Tier provides for weekend discounts (see Sections 3.3 and 3.4).
6.3  Cancellation and Rescheduling of a Booked Session
Members may cancel or reschedule a booked Session at no penalty by providing Drift Away with at least twenty-four (24) hours’ notice before the scheduled start time of the Session. Notice may be given through the online booking system, by telephone, or in person.
6.4  Late Cancellation and No-Show Fees
Drift Away requires twenty-four (24) hours’ notice to cancel or reschedule a booked Session. Failing to provide this notice results in the following fees, charged to the credit card on file in addition to any Credit applied to the booking:
Cancellation or rescheduling with less than twenty-four (24) hours’ notice: a fee equal to fifty percent (50%) of the standard (non-Member) price of the booked Service.
No-Show (failure to attend a booked Session without prior notice): a fee equal to one hundred percent (100%) of the standard (non-Member) price of the booked Service.
These fees apply regardless of the reason for the late cancellation or No-Show. Where a Member’s tier provides discounts on additional Sessions, those discounts do not apply to late cancellation or No-Show fees — the fees are calculated against the standard, non-Member price.
6.5  Late Arrival
Members arriving more than fifteen (15) minutes late for a booked Session may have their Session shortened to fit the remaining time slot, or, at the discretion of Drift Away staff, may be treated as a No-Show subject to Section 6.4.

7.  MEMBERSHIP CANCELLATION
7.1  How to Cancel
A Member may cancel their Membership at any time by contacting Drift Away through one of the following methods:

These two channels are the only valid methods of cancellation, as they create a clear written or in-person record of the request. Cancellation requests submitted by telephone, voicemail, social media, third-party platforms, or verbal communication with staff outside of an in-person front-desk visit will not be considered valid notice and will not stop recurring billing.
7.2  Effective Date of Cancellation
Cancellation takes effect at the end of the current Billing Cycle. The Member will continue to have full access to Membership benefits and any remaining Credits until the next Billing Date, at which point no further charges will be made and Membership benefits will end. No partial refunds are issued for the current Billing Cycle.
7.3  Unused Credits at Cancellation
Any Credits remaining unused at the effective date of cancellation will expire on that date and have no cash value. Members are encouraged to use all available Credits before their effective cancellation date.
7.4  No Pause or Freeze Option
Drift Away does not currently offer a pause, hold, or freeze option for Memberships. Members who wish to temporarily stop their Membership must cancel under Section 7 and may re-enrol at any future date, subject to current pricing and Terms in effect at the time of re-enrolment.
7.5  Termination by Drift Away
Drift Away reserves the right to suspend or terminate any Membership at its sole discretion for reasons including but not limited to: non-payment, breach of these Terms, breach of the Liability Waiver, conduct that endangers or disrupts other guests or staff, or any conduct that, in the reasonable judgment of Drift Away, is incompatible with the wellness environment we maintain. In the event of termination for cause, no refund will be issued.

8.  LIABILITY WAIVER AND ASSUMPTION OF RISK
8.1  Mandatory Waiver
All Members must complete and sign the Drift Away Liability Waiver before their first Session. The Waiver may be signed online via the confirmation email link or in person at the front desk. The Liability Waiver forms part of the agreement between the Member and Drift Away and is incorporated into these Terms by reference.
8.2  Health Disclosures
Members are responsible for disclosing any medical conditions, allergies, pregnancies, or physical limitations that may affect their safe participation in any Service. Members must consult a physician before using contrast therapy, sauna, halotherapy, bath therapy, or any other Service if they have any uncertainty about whether the Service is safe for them. Drift Away staff are not qualified to provide medical advice.
8.3  Assumption of Risk
By participating in any Service, the Member acknowledges that wellness treatments — including but not limited to hot and cold therapies, saunas, bath therapies, and other heat or water-based experiences — involve inherent risks. The Member voluntarily assumes those risks and agrees that, to the maximum extent permitted by law, Drift Away, its owners, employees, and agents are not liable for injury, illness, or loss arising from the use of any Service, except where caused by gross negligence or willful misconduct.

9.  SPA CONDUCT AND POLICIES
9.1  General Conduct
Drift Away is a wellness environment. Members agree to conduct themselves in a manner consistent with that environment, including respecting the quiet enjoyment of other guests, following posted facility rules, and treating staff with courtesy. Drift Away reserves the right to refuse service or remove from the premises any individual whose conduct is, in our reasonable judgment, disruptive, unsafe, or inappropriate.
9.2  Hygiene and Attire
Members are expected to shower before entering any bath or water feature and to wear appropriate attire as posted in the facility. Drift Away may refuse access to any Service if a Member is not appropriately prepared.
9.3  Intoxication
Members who appear to be under the influence of alcohol or non-prescription drugs at the time of a Session may be refused service. No refund or Credit replacement will be provided in such cases.
9.4  Right to Refuse Service
Drift Away reserves the right to refuse service to any Member at any time where, in our reasonable judgment, providing the Service would create a safety risk, violate these Terms, or be inconsistent with our operating standards.

10.  PRIVACY
Drift Away collects, uses, and stores personal information (including name, contact details, payment information, and health disclosures relevant to Service safety) in accordance with our Privacy Policy, available at driftawaywellness.ca. By enrolling in a Membership, the Member consents to the collection and use of personal information as described in the Privacy Policy.
Members may request access to or correction of their personal information at any time by contacting frontdesk@driftawaywellness.ca.

11.  COMMUNICATIONS
By enrolling, the Member consents to receive transactional communications from Drift Away related to their Membership, including booking confirmations, billing notices, expiry reminders, policy updates, and customer service communications. These communications are part of the Membership service and cannot be unsubscribed from without cancelling the Membership.
Marketing communications (including newsletters, promotions, and offers) require separate opt-in consent and may be unsubscribed from at any time without affecting Membership status.

12.  INTELLECTUAL PROPERTY
The Drift Away name, logo, brand elements, Membership Tier names (Drift Essential, Drift Immerse, and Drift Sanctuary), branded experience names (including but not limited to Loonie Tune Up and Nordic Ritual), and all related content are the property of Drift Away Wellness Spa. Members do not acquire any rights to this intellectual property by virtue of their Membership and may not use Drift Away branding, content, or imagery for commercial purposes without prior written consent.

13.  LIMITATION OF LIABILITY
To the maximum extent permitted by law, the total liability of Drift Away, its owners, employees, contractors, and agents arising out of or related to a Member’s Membership shall not exceed the total amount paid by that Member in Membership fees during the twelve (12) months immediately preceding the event giving rise to the claim.
In no event shall Drift Away be liable for indirect, incidental, consequential, special, or punitive damages, including but not limited to lost wages, loss of enjoyment, or emotional distress, arising from any aspect of the Membership or use of any Service, except where such liability cannot be excluded by law.
Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under Alberta consumer protection law or other applicable legislation.

14.  CHANGES TO THESE TERMS
Drift Away may update these Terms from time to time. Material changes to these Terms will be communicated to active Members by email at least thirty (30) days before they take effect. If a Member does not agree to the updated Terms, they may cancel their Membership under Section 7 with no penalty before the changes take effect. Continued use of the Membership after the effective date of any updated Terms constitutes acceptance of those updated Terms.
Non-material changes (such as corrections to grammar, formatting, contact information, or clarifying language that does not alter Member rights or obligations) may be made without notice.

15.  GOVERNING LAW AND DISPUTE RESOLUTION
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable in Alberta. Any dispute arising out of or related to these Terms or the Membership shall be resolved in the courts of Alberta, located in Calgary, and the parties consent to the exclusive jurisdiction of those courts.
Before initiating any formal dispute, the Member and Drift Away agree to attempt in good faith to resolve the dispute through direct discussion. Members are encouraged to contact frontdesk@driftawaywellness.ca with any concern before escalating.

16.  SEVERABILITY AND ENTIRE AGREEMENT
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be severed and the remaining provisions shall remain in full force and effect.
These Terms, together with the Privacy Policy and the Liability Waiver, constitute the entire agreement between the Member and Drift Away regarding the Membership and supersede any prior agreements, communications, or representations, whether oral or written.

17.  SINGLE SOURCE OF TRUTH
These Terms are the authoritative and complete statement of the agreement between you and Drift Away regarding your Membership. Drift Away may, from time to time, summarize or describe Membership policies in other materials — including but not limited to the membership page on driftawaywellness.ca, confirmation emails, billing receipts, cancellation confirmation emails, brochures, in-spa signage, and verbal explanations by staff.
Such summaries are provided for convenience and clarity only. In the event of any inconsistency, omission, or conflict between these Terms and any other written or verbal description of Membership policy, these Terms prevail. Members are encouraged to consult these Terms directly for the complete and current policy on any matter.
Drift Away will make these Terms available at all times at driftawaywellness.ca and will provide a copy on request.

By enrolling in a Drift Away Membership through any channel — online, by telephone, or in person — the Member acknowledges that they have read, understood, and agreed to these Terms in their entirety, and agrees to be bound by them throughout the duration of their Membership.
